These terms and conditions include general terms and conditions for use of this Site, terms and conditions relating to the services provided by Ten Health & Fitness on the site and in our studio.

Please read these terms and conditions carefully. Your use of the site, the purchase of any Products or Services on this site or in a studio will be subject to these terms and conditions. And you now hereby agree to our terms and conditions.

Important Liability Statement

The information available on or through this site, and the Services supplied via or in connection with this site or at any Ten Health & Fitness studios do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that such contents and services are suitable for you. It is not our responsibility to do so. Before commencing any exercise regime, you should consult your doctor.

It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this site (and provided by us to you as part of any Services or Products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this site or provided through any Service supplied by us to you.

You, your legal representatives and your heirs release, waive, discharge and covenant, not to sue Ten Health & Fitness and its instructors for any injury or death caused by their negligence or other acts.

Warranties

Ten Health & Fitness warrants that the Products and Services will be supplied with reasonable skill and care.

Definitions

In these terms and conditions, the following definitions apply: “Services” means any information and services ordered and/or provided by Ten Health & Fitness through or via the Site or our studios and all services offered as part of any course or workshop. Any electronic information supplied to you by Ten Health & Fitness will constitute part of “Service” not a Product and cancellation rights will apply accordingly. “Products” means any products offered for sale on the Site or in a Ten Health & Fitness studio. “Site” means the web site at the URL www.ten.co.uk or replacement site(s) from time to time.

Site Usage and Intellectual Property Rights

You may use the Site for personal and lawful use and in accordance with these terms and you may not copy or use any material from the site for any commercial purpose.

The intellectual property rights in all contents of the site and supplied as part of the Products or Services, and in the Ten Health & Fitness brands’ trade marks and logos (“Materials”) are owned by Ten Health & Fitness. Except to the extent expressly set out in these terms and conditions, you are not allowed to make any copies of any part of any Materials, or remove or change anything on the site, include or create links to or from the site without our written authority, or remove or change any copyright, trade mark or other intellectual property right notices contained in any Materials or copies thereof. “Ten Health & Fitness” is a registered trade mark or application for a registered trade marks owned by Ten Health & Fitness. You must not use the Ten Health & Fitness brand, logos or marks without written licence.

You must not use the site to post, upload or otherwise transmit material which is obscene or pornographic, threatening, menacing, racist, offensive, defamatory, infringing of any intellectual property or otherwise unlawful, to harass, stalk, threaten or otherwise violate the rights of others, to misrepresent your identity or status, to hack into this site or any other related computer system, to make excessive traffic demands, deliver viruses or forward chain letters or similar materials that may reasonably be expected to inhibit other users from using and enjoying the site or any other web site or damage or destroy the reputation of Ten Health & Fitness.

Ten Health & Fitness accepts no obligation to monitor the use of the site. However, Ten Health & Fitness reserves the right to disclose any information as required by law and/or to remove, refuse to post or to edit any information or materials, to block your access and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions or any breach of applicable law or regulation.

Ten Health & Fitness will also in its absolute discretion fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security. You should refresh your browser each time you visit the site to ensure that you download the most up to date version of the site as we may change the site from time to time.

Your Personal Information

Usage of your personal information is governed by the Ten Health & Fitness privacy policy, which forms part of these Terms and Conditions.

Liability

You are referred to the important liability statement at the top of these terms and conditions. Subject to that statement you agree that your use of this Site and the Service is on an “as is” and “as available” basis. On that basis, except as expressly set out in these terms, Ten Health & Fitness does not enter into conditions, warranties or other terms in relation to the site or the Products or the Services (including any implied term relating to quality, fitness for a particular purpose) or any guaranteed or predicted result.

The site may include links to external sites and co-branded pages. Ten Health & Fitness has included links to these sites and co-branded pages to provide you with access to information and services that you may find useful or interesting, However, Ten Health & Fitness is not responsible for the content of these site and pages or for anything provided by them.

Subject to the important liability statement, Ten Health & Fitness is not liable for failure to comply with these terms and conditions due to any event beyond its reasonable control, including, without limitation, the input of incorrect information by you.

Suspension and termination of Service

Ten Health & Fitness may suspend the operation of the site for repair or maintenance work or in order to update or upgrade the contents or functionality of the site from time to time. Access to or use of the site or any sites or pages linked to it will be not necessarily be uninterrupted or error free.

Ten Health & Fitness may terminate the Service immediately in the event you breach any of these terms and conditions or do not pay any sums due to Ten Health & Fitness (including if the credit/debit card you use is not valid or does not work for another reason).

Contract Information

No contract will exist in relation to the Services or Products until we have confirmed to you by email the particulars of your order, the value of your order and the Products or Services (as applicable) you have purchased.

Pricing

Information displayed on the site or in our studio as to pricing and availability is subject to change by Ten Health & Fitness without notice.

General

We reserve the right to cancel any classes, sessions, blocks or memberships and/or to refuse entry to any/all our sites at our discretion if:

  • in our professional opinion, we consider that you are not medically or physically able to use our facilities safely, or that it is not in your best interests to continue attending classes or sessions at Ten
  • you are in serious or repeated breach of our terms and conditions
  • you have booked or have attended classes or sessions without payment
  • in our reasonable opinion, we consider your behaviour or language to be offensive, abusive, harassing, threatening or discriminatory to our staff, our business or to other clients, whether in our studios or online
  • your behaviour or conduct does or, may, risk the physical or mental wellbeing of our staff

Ten Health & Fitness may change these terms and conditions from time to time. By browsing the site you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.

These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.

Statutory Rights and Refunds and Cancellation

The rights of cancellation and refund and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer. Refunds in relation to Products or Services may only be credited to the credit or debit card originally used to make the purchase. An administration fee of £50.00 is applicable.

Terms & Conditions: Classes

 
You must be 18 or over to attend classes at Ten. Classes are always subject to availability but we will always do our best to accommodate you in your chosen class.

All classes must be prepaid and all clients agree to our 12hr notice policy when cancelling and/or rescheduling. If you’re booked into a class, but miss it or cancel with less than 12 hours’ notice, you will be charged for it.

Out of consideration for the Trainer and other Clients, and also for your own safety (the warm-up is an important aspect of each class) please be aware that if you are more than 5 minutes late for a class, you will not be able to train.

Classes and Personal training sessions are valid for 6 months from the date of purchase, unless stated otherwise.

Statutory Rights and Refunds and Cancellation

Classes are sold individually, and in blocks of 5, 10 and 30 or such other combinations as Ten Health & Fitness may introduce from time to time. Blocks of classes may be shared by arrangement. Class fees are non refundable.

Class fees may be increased by Ten Health & Fitness at any time. The Proprietor shall give Clients not less than 14 days notice prior to any such increases.

The rights of cancellation and refund and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer. Refunds in relation to Products or Services may only be credited to the credit or debit card originally used to make the purchase. An administration fee of £50.00 is applicable.

Terms & Conditions: Massage & Physio Sessions

 

Therapy Appointments

Upon making a booking, you will receive an email confirming all the important details, along with an email reminder 24hrs prior to your appointment. Please check that all information (studio, appointment time, appointment type) are correct.

First appointment bookings will receive a New Client Consultation Form via your confirmation email. Please fill this in prior to your appointment as completion on the day will be part of your appointment time.

Block Purchases

Massage and Physio blocks are sold in blocks of 5 and 10 or such other combinations as Ten Health & Fitness may introduce from time to time and are valid for a period of 12 months from the date of purchase unless stated otherwise. Blocks of massage may be shared by prior agreement. Fees are non-refundable and there is no cash alternative. Blocks purchased are a contract with Ten Health & Fitness and not with any specific therapist and not liable for refund if preferred therapist is unavailable.

Cancellations & Late Cancellation Policy: 24 HOURS

Ten Health & Fitness operate a 24h cancellation policy whereby any booked sessions must be cancelled at least 24 hours before the scheduled start time. In any other case, the session will be charged and, if applicable, be deducted from the remainder of your package. Failure to attend an appointment with less than 24 hours’ notice of cancellation will incur the charge for the full appointment.

If you need to cancel your appointment at short notice because of Covid-19 related symptoms, a long-term medical condition which varies from day to day, or because you are more than 37 weeks pregnant, then we shall discuss the cost implications on a case-by-case basis.

Late Arrivals: Please arrive a few minutes prior to the start of your appointment time. If you need to arrive later or leave earlier, it is your discretion to do so, but time will not be made up by overrunning or adding time to subsequent appointments.

Confidentiality

All client information and clinical records will be safeguarded by Ten Health & Fitness and will remain confidential. Unless required to do so by law, we will not otherwise share, sell or distribute any of the information you provide to us without your consent.

Consultations and client treatment details will not be discussed with anyone other than the client, unless the client is under the age of 18 or has a care worker or guardian.

In order to prevent unauthorised access or disclosure, we employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We have also put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We will retain your information for a reasonable period or as long as the law requires.

Each practitioner working for Ten Health & Fitness will have access to these records only for the duration of their contract with Ten Health & Fitness, and solely for the purpose of providing you with the most appropriate treatment.

Health & Safety

All practitioners at Ten Health & Fitness are qualified, hold a current First Aid certificate, and hold professional and public indemnity insurance, for the services that they provide.

Due to the nature of hands-on physio and massage therapy, and the need for close contact, all Ten Health & Fitness practitioners will maintain a high standard of personal hygiene and clients are asked to ensure that they also maintain a high standard of personal hygiene.

If a practitioner is unwell, suffering from a cold or virus, infection or general ill health, they will not be allowed to work due to the risks of cross contamination. This may result in Ten Health & Fitness contacting you to inform you of the issue at the earliest opportunity to make suitable alternative arrangements.

Clients are asked not to attend an appointment if they are unwell, suffering from a cold or virus, infection or general ill health. Please contact the studio you are booked in at the earliest opportunity to rearrange your appointment. If you are unwell and contact us to inform us of your illness and choose to cancel without rescheduling, charges may still apply.

Ten Health & Fitness, including the practitioners, will not be held responsible for the loss or damage of personal items during your time at the Ten Health & Fitness premises.

Ten Health & Fitness holds the right to refuse any treatment if a client is physically or verbally abusive towards any practitioner, or demonstrates inappropriate, aggressive or sexual behaviour. Such behaviour may result in a partial or total ban from Ten Health & Fitness and may also result in criminal proceedings.

Disclaimer

The client has a duty to provide accurate and true medical and personal information, to the best of their knowledge, and to keep Ten Health & Fitness up to date with details of any medication, symptoms, medical concerns or treatments they are having investigated or undergoing treatment for.

All practitioners at Ten Health & Fitness may refuse to treat any client or part of their body with just and reasonable cause. Ten Health & Fitness reserves the right to terminate any appointment at any time if they believe that it is not safe or in the client’s best interest to continue. Likewise, the client has the right to refuse, modify or terminate treatment at any time, regardless of prior consent given.

Terms & Conditions: Monthly Memberships

 

– Monthly 4

This membership comprises 4 Classes at Ten Health & Fitness per month for a monthly fee of £110.

If any additional classes are taken within the specified billing month, they will be charged to the card on file at the rate of £22/session. All charges will be taken within 14 days of the previous billing period.

The agreement runs for a minimum of 3 months from the start date, and can not be terminated, cancelled or paused before this time. It will automatically be renewed for subsequent months, unless cancelled by either the client or Ten Health & Fitness. Written cancellation is required with a minimum of 31 days notice.

Terms and Conditions: 

  • Classes can not be frozen or extended
  • Classes are valid at all studios exc Little Venice and Tottenham Court Road
  • Membership applies to all standard classes and excludes Physio-Led Pilates
  • Membership blocks, status or benefits can not be shared
  • Memberships can not be refunded
  • Additional classes can be purchased at the rate of £22/session

– Monthly 7

This membership comprises 7 classes at Ten Health & Fitness per month for a monthly fee of £169.

If any additional classes are taken within the specified billing month, they will be charged to the card on file at the rate of £22/session. All charges will be taken within 14 days of the previous billing period.

The agreement runs for a minimum of 3 months from the start date, and can not be terminated, cancelled or paused before this time. It will automatically be renewed for subsequent months, unless cancelled by either the client or Ten Health & Fitness. Written cancellation is required with a minimum of 31 days notice.

All Monthly 7 members will receive membership status and the ability to make advanced bookings. When this agreement is terminated, membership status and all member benefits end.

  • Classes can not be frozen or extended
  • Classes are valid at all studios exc Little Venice and Tottenham Court Road
  • Membership applies to all standard classes and excludes Physio-Led Pilates
  • Membership blocks, status or benefits can not be shared
  • Memberships can not be refunded

– Monthly 10

This membership comprises 10 classes at Ten Health & Fitness per month for a monthly fee of £235.

If any additional classes are taken within the specified billing month, they will be charged to the card on file at the rate of £22/session. All charges will be taken within 14 days of the previous billing period.

The agreement runs for a minimum of 3 months from the start date, and can not be terminated, cancelled or paused before this time. It will automatically be renewed for subsequent months, unless cancelled by either the client or Ten Health & Fitness. Written cancellation is required with a minimum of 31 days notice.

All Monthly 10 members will receive the ability to make advanced bookings. When this agreement is terminated, membership status and all member benefits end.

This membership comprises 12 classes at Ten Health & Fitness per month for a monthly fee of £270.

If any additional classes are taken within the specified billing month, they will be charged to the card on file at the rate of £22/session. All charges will be taken within 14 days of the previous billing period.

The agreement runs for a minimum of 3 months from the start date, and can not be terminated, cancelled or paused before this time. It will automatically be renewed for subsequent months, unless cancelled by either the client or Ten Health & Fitness. Written cancellation is required with a minimum of 31 days notice.

All Monthly 12 members will receive the ability to make advanced bookings. When this agreement is terminated, membership status and all member benefits end.

  • Classes are valid at all studios exc Little Venice and Tottenham Court Road
  • Membership applies to all standard classes and excludes Physio-Led Pilates

– Monthly Unlimited

This membership comprises Unlimited Classes at Ten Health & Fitness for a monthly fee of £345.

If any booked classes are late cancelled or missed, they will be charged to the card on file at the rate of £15/session. All charges will be taken within 14 days of the previous billing period.

The agreement runs for a minimum of 3 months from the start date, and can not be terminated, cancelled or paused before this time. It will automatically be renewed for subsequent months, unless cancelled by either the client or Ten Health & Fitness. Written cancellation is required with a minimum of 31 days notice.

Terms and Conditions:

  • Classes can not be frozen or extended
  • Classes are valid at all studios exc Little Venice and Tottenham Court Road
  • Max 2 Classes per day for Health & Safety
  • Membership applies to all standard classes and excludes Physio-Led Pilates
  • Membership blocks, status or benefits can not be shared
  • Memberships can not be refunded
  • Late cancellations/no-shows will be processed at the rate of £15/session

– Monthly Massage (1 per month)

This membership comprises 1 x 60 min Massage at Ten Health & Fitness per month for a monthly fee of £85.

The agreement runs for a minimum of 3 months from the start date, and can not be terminated, cancelled or paused before this time. It will automatically be renewed for subsequent months, unless cancelled by either the client or Ten Health & Fitness. Written cancellation is required with a minimum of 31 days notice.

Terms and Conditions:

  • Massages can not be frozen or extended
  • Massages are valid at all studios
  • Memberships can not be refunded

– Monthly Massage (2 per month)

This membership comprises 2 x 60 min Massages at Ten Health & Fitness per month for a monthly fee of £160.

The agreement runs for a minimum of 3 months from the start date, and can not be terminated, cancelled or paused before this time. It will automatically be renewed for subsequent months, unless cancelled by either the client or Ten Health & Fitness. Written cancellation is required with a minimum of 31 days notice.

Terms and Conditions:

  • Massages can not be frozen or extended
  • Massages are valid at all studios
  • Memberships can not be refunded

Terms & Conditions: PT Monthly Rolling Contracts

All PT Monthly agreements run for a minimum of 3 months from the start date. They will then automatically renew for subsequent months, unless cancelled by either the client or Ten Health & Fitness. Written cancellation is required with a minimum of 31 days notice.

If any additional sessions are taken within the specified billing month, they will be charged to the card on your account at the specified rate for your training tier (Master/Senior/Standard).

Terms and Conditions:

  • PTs can not be frozen or extended
  • PTs are valid at all studios exc Little Venice
  • PT Monthly blocks are valid on 60min Personal Training sessions
  • PT blocks, status or benefits can not be shared
  • Rolling contracts can not be refunded
  • Additional sessions can be purchased at the specified rate for your training tier

T&Cs: Giftcards

– Giftcards expire 6 months from purchase of card.
